  • The clinic which undertakes the surrogacy procedure must be registered under the surrogacy act.

  • The intending couple is obliged not to abandon the child for any reason, medical condition, genetic defects, sex of the child, etc be it in India or abroad.

  • The procedure of handing over the child can be done immediately after birth or after the breastfeeding period (decided by the intended couples and the surrogate).
